2. Description of Service

DispatchKit.app is an event routing platform that enables developers and engineering teams to send events via HTTP POST requests and route them to various notification channels including Slack, Discord, Microsoft Teams, WhatsApp, SMS, email, and other integrated services. The Service provides webhook management, multi-channel routing, filtering, analytics, and related developer tools.

3. User Accounts and Registration

3.1 Account Creation

  • You must provide accurate, complete, and current information during registration
  • You are responsible for maintaining the confidentiality of your account credentials
  • You must be at least 18 years old or have parental consent to use the Service
  • Corporate accounts must be registered by authorized representatives

3.2 Account Security

  • You are solely responsible for all activities under your account
  • You must notify us immediately of any unauthorized access or security breaches
  • We reserve the right to suspend accounts showing suspicious activity

4. Acceptable Use Policy

4.1 Permitted Uses

  • Send legitimate application events and notifications
  • Route events to authorized channels and recipients
  • Monitor and analyze your own event data
  • Integrate the Service with your applications and workflows

4.2 Prohibited Uses

You may not use the Service to:

  • Send spam, unsolicited communications, or malicious content
  • Transmit illegal, harmful, or offensive material
  • Violate any applicable laws or regulations
  • Attempt to gain unauthorized access to our systems
  • Interfere with or disrupt the Service's functionality
  • Send events containing personal data without proper consent
  • Exceed rate limits or attempt to circumvent usage restrictions
  • Reverse engineer, decompile, or attempt to extract source code

5. API Usage and Rate Limits

5.1 API Access

  • API access is provided subject to your subscription plan
  • Rate limits apply and vary by plan tier
  • We reserve the right to modify rate limits with reasonable notice

5.2 Event Delivery

  • We make commercially reasonable efforts to deliver events reliably
  • Automatic retries are provided with exponential backoff
  • We do not guarantee delivery of every event in all circumstances

6. Data and Privacy

6.1 Data Processing

  • We process event data according to our Privacy Policy
  • You are responsible for ensuring compliance with applicable data protection laws
  • We implement industry-standard security measures to protect your data

6.2 Data Retention

  • Event data is retained according to your subscription plan
  • You may request data deletion subject to legal and operational requirements
  • We may retain certain data for security and compliance purposes

7. Subscription Plans and Billing

7.1 Free Tier

  • Limited event volume and features as specified on our pricing page
  • Subject to fair use policies
  • May include service limitations or restrictions

7.2 Paid Plans

  • Billed monthly or annually as selected
  • Charges are non-refundable unless otherwise specified
  • Plan changes take effect at the next billing cycle
  • Usage overages may result in additional charges

7.3 Payment Terms

  • Payment is due upon subscription activation
  • Auto-renewal applies unless cancelled
  • We may suspend service for non-payment after reasonable notice

8. Service Availability and Support

8.1 Service Level

  • We strive for 99.9% uptime but do not guarantee uninterrupted service
  • Planned maintenance will be communicated in advance when possible
  • Support is provided according to your subscription plan

8.2 Third-Party Integrations

  • We are not responsible for the availability or functionality of third-party services
  • Integration issues with external platforms are outside our control
  • We will make reasonable efforts to maintain compatibility with supported services

9. Intellectual Property

9.1 Our Rights

  • We retain all rights to the DispatchKit platform, technology, and related intellectual property
  • Our trademarks and branding remain our exclusive property

9.2 Your Rights

  • You retain ownership of your event data and content
  • You grant us necessary rights to process and route your events as requested
  • We may use aggregated, anonymized data for service improvement

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

  • OUR LIABILITY IS LIMITED TO THE AMOUNT PAID BY YOU IN THE 12 MONTHS PRECEDING THE CLAIM
  • WE ARE NOT LIABLE FOR INDIRECT, CONSEQUENTIAL, OR INCIDENTAL DAMAGES
  • WE DO NOT GUARANTEE DELIVERY OF ALL EVENTS OR CONTINUOUS SERVICE AVAILABILITY
  • YOU USE THE SERVICE AT YOUR OWN RISK

11. Indemnification

You agree to indemnify and hold us harmless from claims arising from:

  • Your use of the Service
  • Violation of these Terms
  • Infringement of third-party rights
  • Your event data or content

12. Termination

12.1 By You

  • You may cancel your subscription at any time
  • Cancellation takes effect at the end of the current billing period
  • No refunds for partial periods unless required by law

12.2 By Us

We may suspend or terminate your account for:

  • Violation of these Terms
  • Non-payment of fees
  • Illegal or harmful activities
  • Extended periods of inactivity

13. Changes to Terms

  • We may modify these Terms with 30 days' notice
  • Continued use constitutes acceptance of changes
  • Material changes will be communicated via email or platform notification

14. Developer-Specific Terms

14.1 API Usage

  • API access is provided "as-is" with no warranty of specific functionality
  • Breaking changes to APIs will be communicated with reasonable advance notice
  • Deprecated features will be supported for a minimum transition period

14.2 Integration Responsibility

  • You are responsible for proper implementation and error handling
  • We recommend implementing fallback mechanisms for critical notifications
  • Test your integrations thoroughly before production deployment

15. Enterprise Terms

For Enterprise customers:

  • Additional terms may apply per your Master Service Agreement
  • Service Level Agreements (SLAs) are defined in separate agreements
  • Custom terms supersede these general terms where applicable

16. Governing Law and Disputes

  • These Terms are governed by UK law
  • Disputes will be resolved through binding arbitration
  • You waive the right to participate in class-action lawsuits

17. Miscellaneous

17.1 Entire Agreement

These Terms constitute the entire agreement between you and DispatchKit.app regarding the Service.

17.2 Severability

If any provision is found unenforceable, the remaining terms continue in full effect.

17.3 Assignment

We may assign these Terms; you may not assign your rights without our consent.
